根据《中华人民共和国劳动法》(以下简称《劳动法》)、《中华人民共和国劳动合同法》(以下简称《劳动合同法》)、《深圳市员工工资支付条例》(以下简称《工资支付条例》)等有关法律法规的规定,甲乙双方遵循合法、公平、平等自愿、协商一致、诚实信用的原则,签订本劳动合同,共同遵守本劳动合同所列条款。
The contract is hereby concluded by both parties in accordance with Labor Law of the People's Republic of China, Labor Contract Law of the People’s Republic of China, and Regulations of the Shenzhen Municipality on the Wage Payment to Employees , in the principles of fairness, legitimacy, equality, voluntariness, consensus through negotiation and good faith.

三、工作时间和休息休假
Article3、Working Hours, Rest and Leave Entitlements
(一)甲乙双方同意按以下第 种方式确定乙方的工作时间。
The working hours shall be determined as set forth in Item below.
1、标准工时制,即每日工作 小时(不超过8小时),每周工作 小时(不超过40小时),每周至少休息一日。
The normal working hour system shall be implemented. Party B shall work no more than hours a day (no more than 8), and hours a week (no more than 40), and shall have at least one day’s rest each week.
2、不定时工作制,即经人力资源保障(劳动)部门批准,乙方所在岗位实行不定时工作制。
A non-fixed working hour system shall be implemented with the necessary approval from the relevant labor administration authorities.
3、综合计算工时工作制,即经人力资源保障(劳动)部门批准,乙方所在岗位实行综合计算工时工作制。
Cumulative working hour’s system approved by the labor and social security department and the Calculation period is .
(二)甲方由于生产经营需要延长工作时间的,按《劳动法》第四十一条执行。
Due to its operational needs, Party may extend Party B’s work overtime on weekends based forty-first Labor Law of the People's Republic of China.
(三)乙方依法享有法定节假日、年休假、婚假、产假、丧假等假期。
Party B shall have public holiday, Annual leave, Marriage leave, Maternity leave and Compassionate leave according to the National Law.

四、劳动报酬
Article4 Working Remuneration
(一)甲方依法制定工资分配制度,并告知乙方。甲方支付给乙方的工资不得低于市政府公布的当年度最低工资。
Party A is entitle to adjust salary of Party B. But will not below the municipal government minimum wage standards.
(二)甲方经与乙方协商,同意按以下第 种方式支付乙方的工资。
The working pay shall be determined as set forth in Item below.
1、乙方每月正常工作时间工资 元;试用期内每月正常工作时间工资 元。
Party B will receive a monthly remuneration of RMB gross during the probation period and RMB gross after the probation period month.

The Employee shall be entitled to legal holidays, annual leave, and other paid leaves of absence in accordance with applicable law and the Company’s work rules, which are in force from time to time.
五、社会保险和福利待遇
Article 5 Social Insurance and Welfare
(一)甲乙双方按照国家和省、市有关规定,参加社会保险,缴纳社会保险费。
Party a and Party B must participate in social insurance and pay social insurance premiums on a monthly basis in accordance with the national and provincial law.
(二)乙方患病或非因工负伤,甲方应按国家和省、市的有关规定给予乙方享受医疗期和医疗期待遇。
Where Party B has contracted an illness or sustained a non-work-related injury, Party A should give Party B medical treatment and medical leave accordance with National or provincial regulation.
(三)乙方患职业病、因工负伤的,甲方按《中华人民共和国职业病防治法》、《工伤保险条例》等有关法律法规的规定执行。
Where Party B has contracted an occupational diseases or industrial injury, party A have to implement related provisions according to the "occupation disease prevention law", industrial injury insurance regulations" and other relevant laws and regulations.
(四)甲方为乙方提供以下福利待遇

六、劳动保护、劳动条件和职业危害防护
Article 6 Labor Protection, Working Conditions and Protections against Occupational Hazards
(一)甲方按照国家和省、市有关劳动保护规定,提供符合国家安全卫生标准的劳动作业场所和必要的劳动防护用品,切实保护乙方在生产工作中的安全和健康。
Party A shall give Party B education and training programs relating to labor safety, professional skills and labor disciplines etc. According to the requirements of state labor protection and safe-production, Party A shall provide necessary working condition to ensure Party B’s safety and health.
(二)甲方按照国家和省、市有关规定,做好女员工和未成年工的特殊劳动保护工作。
Party A must conscientiously carry out relevant provisions formulated by the state for the protection of female and under-aged employees.
(三)乙方从事 作业,可能产生 职业危害,甲方应采取 防护措施,且按照国务院卫生行政部门的规定组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果如实告知乙方。职业健康检查费用由用人单位承担。
The Employee is engaged in the , possible occupation hazard, Employer should take protective measures, and in accordance with the health administrative department of the State Council shall organize job occupation health examination before,during and post time, and the inspection results shall truthfully inform the Employee. Occupation health inspection fees shall be borne by the employer.
(四)乙方有权拒绝甲方的违章指挥和强令冒险作业;对甲方危害生命安全和身体健康的行为,乙方有权要求改正或向有关部门举报。
The Employee must strictly abide by rules of safe operations during working process, and has the right to refuse peccant command and the right to demand correction or report to the relevant departments.
七、规章制度
Article 7 Regulation and Rules
(一)甲方依法制定的规章制度,应当告知乙方。
Party A draw the regulation and rules up accordance to law and shall inform Party B.
(二)乙方应遵守国家和省、市有关法律法规和甲方依法制定的规章制度,按时完成工作任务,提高职业技能,遵守安全操作规程和职业道德。
Party B shall obey the related Law and the Regulation which is draw up by Party A; to complete task on time, comply with the safety rules and occupation moral.
(三)乙方自觉遵守国家和省、市计划生育的有关规定。
Party B shall comply with the Family Planning regulation accordance to the Law.
八、劳动合同变更
Article 8 Alternation of Contract
甲乙双方经协商一致,可以变更劳动合同。变更劳动合同应采用书面形式。变更后的劳动合同文本双方各执一份。
Both of Party A and Party B reach a consensus on alteration of contract, which shall be in written form. Both parties shall keep a copy of revised contract.
九、劳动合同解除和终止
Article 9 Dissolution and Termination of Contract
(一)甲乙双方协商一致,可以解除劳动合同。
Where Party A and Party B reach a consensus, the contract can be terminated.
(二)乙方提前三十日以书面形式通知甲方,可以解除劳动合同;乙方试用期内提前三日通知甲方,可以解除劳动合同。
To terminate the contract, Party B shall inform Party A in written notice in a thirty days advance. Party B in three days advance notice to Party A in probation period.
(三)甲方有下列情形之一的,乙方可以通知甲方解除劳动同:
In any of the following circumstances, Party B may notify Party A to terminate this contract
1、未按照劳动合同约定提供劳动保护或者劳动条件的;
Failure on the part of Party A to provide working conditions as agreed upon this contract.
2、未及时足额支付劳动报酬的;
Failure on the part of Party A to pay labour remuneration.
3、未依法为乙方缴纳社会保险费,经乙方要求甲方缴纳,超过一个月仍未缴纳的;
Party B shall pay social insurance premiums fall short of legal provisions, Party B request Party A to pay, not pay more than a month;
4、规章制度违反法律、法规的规定,损害乙方权益的;
Bylaw violates the legal provisions & regulations, damage to Party B's rights and interests;
5、以欺诈、胁迫的手段或者乘人之危,使乙方在违背真实意思的情况下订立或者变更本劳动合同,致使劳动合同无效的;
By means of fraud and intimidation or position of vulnerability, so that Party B conclude or change the labor contract in violation of the true meaning of the case, the labor contract is invalid;
6、免除自己的法定责任、排除乙方权利,致使劳动合同无效的;
Escaping their own legal responsibilities and eliminating Party B’s rights lead to the labor contract invalid;
7、违反法律、行政法规强制性规定,致使劳动合同无效的;
In violation of laws, administrative regulations of the mandatory provisions,the labor contract is invalid;
8、法律、行政法规规定乙方可以解除劳动合同的其他情形。
Legal and administrative regulations, Party B may terminate the labor contract situation.
(四)甲方以暴力、威胁或者非法限制人身自由的手段强迫乙方劳动的,或者甲方违章指挥、强令冒险作业危及乙方人身安全的,乙方可以立即解除劳动合同,不需事先告知甲方。
Party A forces Party B to work by violence, threat or illegal limitations of Party B’s freedom or Party A forces Party B to work by means of force, threat or illegal restriction of personal freedom. Party B may notify Party A of terminating the contract at any time.
(五)乙方有下列情形之一的,甲方可以解除劳动合同:
The Company may dismiss the Employee at any time without further notice if the Employee:
1、在试用期间被证明不符合录用条件的;
Is proven to be incompetent for the employing requirement during his/her period of probation;
2、严重违反甲方的规章制度的;
Seriously breach labor disciplines or regulations as stipulated by the Company
3、严重失职,营私舞弊,给甲方造成重大损害的;
Seriously neglects his duty and engages in malpractices for selfish ends, thus
causing significant harm to the interests of the Company.
4、同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经甲方提出,拒不改正的;
Party B holds another job without the permit of Party A, which seriously affects the completion of Party A’s work task, or Party B refuses to correct the error after Party A’s warning;
5、以欺诈、胁迫的手段或者乘人之危,使甲方在违背真实意思的情况下订立或者变更本劳动合同,致使劳动合同无效的;
By means of fraud and intimidation or position of vulnerability, so that Party A conclude or change the labor contract in violation of the true meaning of the case, the labor contract is invalid;
6、被依法追究刑事责任的。
Is found guilty according to the laws of P.R.C.
(六)有下列情形之一的,甲方提前三十日以书面形式通知乙方或者额外支付乙方一个月工资后,可以解除劳动合同,《劳动合同法》第四十二条规定的情形除外:
In any of the following circumstances, Party A may terminate this Contract upon prior written notice of thirty (30) days to Party B or one month salary in lieu of the notice,expect forty-second Labor Law of the People's Republic of China:
1、乙方患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事由甲方另行安排的工作的;
Party B, due to sickness or injury inflicted off the job, can not resume his or her work or do the other job reassigned by Party A after specified period of medical treatment;
2、乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;
Party B is unqualified, even after a training or job adjustment.
3、劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,经甲乙双方协商,未能就变更劳动合同内容达成协议的。
The objective conditions on which the contract is based have materially changed to the extent that it is impossible to perform the contract while both parties cannot reach an agreement to amend the contract to reflect the changed conditions.
(七)有下列情形之一,甲方需要裁减人员二十人以上或者裁减不足二十人但占甲方职工总数百分之十以上的,甲方应提前三十日向工会或者全体职工说明情况,在听取工会或者职工的意见,并将裁减人员方案向人力资源保障(劳动)部门报告后,可以裁减人员,《劳动合同法》第四十二条规定的情形除外:
One of the following circumstances,Party A would require reductions in staff of 20 people or more reduction of less than 20 but accounts for more than 10 per cent of the total number of Party workers,Party A shall be thirty days in advance to the trade union or all the workers to explain the situation. After listening to the opinions of the trade union or employees, and will cut staff plan to the guarantee of human resources (labour) Department report, you can reduce the number of personnel,expect forty-second Labor Law of the People's Republic of China:
1、依照企业破产法规定进行重整的;
Party A is declared bankruptcy legally;
2、生产经营发生严重困难的;
In case Party A is face bad business situation;
3、企业转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;
Enterprise transformation,Major technological innovation or Operation mode adjustment.
After amendment of employment contracts , still needs to reduce its workforce;
4、其他因劳动合同订立时所依据的客观经济情况发生重大变化,致使劳动合同无法履行的。
The basis for the conclusion of the contract has greatly changed so that the contract can no longer be carried out,while both parties cannot reach an agreement on modifying the contract by mutual negotiation.
(八)有下列情形之一的,劳动合同终止:
The contract will terminate in case any of the following occurs:
1、劳动合同期满的;
The labor contract expires;
2、乙方达到法定退休年龄的;
Party B shall reach the statutory retirement age;
3、乙方死亡,或者被人民法院宣告死亡或者宣告失踪的;
Party B is dead, pronounced dead or pronounced missing by the people's court;
4、甲方被依法宣告破产的;
Party A is declared bankruptcy legally;
5、甲方被吊销营业执照、责令关闭、撤销或者甲方决定提前解散的;
Party A’s business license is revoked; Party A is compelled to close down or dissolve; or Party A decides to dissolve in advance
6、法律、行政法规规定的其他情形。
Other situations stipulated in laws and administrative provisions
十、经济补偿
Article 10:Economic compensation
(一)符合下列情形之一的,甲方应当向乙方支付经济补偿:
Party A shall pay economic compensation to Party B in follow case;
1、甲方依据本劳动合同第九条第(一)项规定向乙方提出解除劳动合同并与乙方协商一致解除劳动合同的;
Party A to Party B in accordance with the labor contract in Article 9 ( a ) the provisions of proposed dissolution of the labor contract , and in consultation with the Party B agreed to terminate the labor contract;
2、乙方依据本劳动合同第九条第(三)项、第(四)项规定解除劳动合同的;
Party B in accordance with the labor contract in Article 9 (3) or paragraph (4) provides labor contract is terminated ;
3、甲方依据本劳动合同第九条第(六)项、第(七)项规定解除劳动合同的;
Party A according to the labor contract of article 9 ( 6 ) , the provisions of paragraph ( 7) of the labor contract is terminated;
4、除甲方维持或者提高劳动合同约定条件续订劳动合同,乙方不同意续订的情形外,依据本合同第九条第(八)项第1目规定终止固定期限劳动合同的;
In addition to party a to maintain or improve the condition of the labor contract renew the labor contract ,Party B does not agree to renew the situation,,Fixed term labor contract is terminated pursuant to this Agreement in Article 9 ( 8 ) of the first subparagraph;
5、依据本合同第九条第(八)项第4目、第5目规定终止劳动合同的;
on the basis of this contract Article ninth ( eight ) of fourth, fifth eyes required to terminate the labor contract;
6、法律、行政法规规定的其他情形。
Other situations stipulated in laws and administrative provisions.
(二)甲乙双方解除或终止本劳动合同的,经济补偿的发放标准应按《劳动合同法》以及国家和省、市有关规定执行。甲方依法应向乙方支付经济补偿的,应在乙方办结工作交接时支付。
Both parties rescind or terminate the labor contract, the economic compensation shall be issued standard of Labor Law of the People's Republic of China and the national and provincial, municipal relevant regulations. Party A shall pay economic compensation to Party B,when Party B upon the hand-over.
十一、劳动合同解除和终止手续
Article 10:The labor contract rescission and termination procedures
甲乙双方解除或终止本劳动合同的,乙方应按双方约定,办理工作交接等手续。甲方应当在解除或者终止劳动合同时出具解除或者终止劳动合同的证明,并在十五日内为乙方办理档案和社会保险关系转移手续。甲方出具的解除或者终止劳动合同的证明,应当写明劳动合同期限、解除或者终止劳动合同的日期、工作岗位、在本单位的工作年限。
Both parties rescind or terminate the labor contract, Party B shall be agreed by both parties, handle the handover procedures. Party A shall prove in dissolution or termination of labor contracts issued by the dissolution or termination of the labor contract, and in fifteen days the transfer Party B's archives and social insurance. Certificate issued by Party A shall discharge or termination of the labor contract, shall state the time limit, the lifting of the labor contract or termination of the labor contract date, job, working life in the unit.
十二、争议处理
Article 12: Settlement of Disputes
甲乙双方发生劳动争议的,应先协商解决。协商不成的,可以向本单位工会寻求解决或向本单位劳动争议调解委员会申请调解;也可以直接向劳动争议仲裁委员会申请仲裁。
If labor dispute occurs, both parties shall resolve it through consultation. In case of failing to reach an agreement, each party may submit the dispute to Labor Dispute Arbitration Committee having jurisdiction.If rejecting the award, each party can take a proceeding. The party applying for arbitration shall submit the arbitration application to Labor Dispute Arbitration Committee .
十三、双方认为需要约定的其他事项:

十四、其它
Article 14. Miscellaneous
(一)本劳动合同未尽事宜或劳动合同条款与现行法律法规规定有抵触的,按现行法律法规执行。
Other issues not mentioned herein shall be subject to the laws, statues and provisions stipulated by the local and central governments.
(二)本劳动合同自甲乙双方签字盖章之日起生效,涂改或未经书面授权代签无效。
The original contract will be invalid on the date when the contract comes into force.
(三)本劳动合同一式两份,甲乙双方各执一份。
The contract is in duplicate, held by Party A and Party B respectively. The contract comes into effect upon signatures or seals of both parties.
