6. DEMURRAGE AND /DESPATCH
DEMURRAGE: USD18,000 PER DAY OR PRO-RATA FOR ALLTIME LOST AT BOTH ENDS/ USD 9,000 PER DAY OR PRO-RATA FOR LAYTIME SAVED
滞期费:每天 18,000美元/天,速遣费每天 9,000美元/天不足一天按比例计算
LOADING PORT DEMURRAGE/DESPATCH TO BE SETLLED WITHIN 7DAYS AFTER COMPLETETION OF LOADING & SUBMISSION OF DOCUMENT.
DISCHARGING PORT DEMURRAGE/DESPATCH TO BE SETLLED WITHIN 7 DAYS AFTER COMPLETION OF DISCHARGING AND SUBMISSION OF DOCUMENTS.
在装港的滞期费和速遣费, 在装完货后,依据相关的文件,在七天内结算, 卸港时的滞期费和速遣费, 在卸完货后,依据相关的文件,在七天内结算.
7.FREIGHT RATE:
USD PER MT ON FIOST BSS 1/1.
FREIGHT SHALL BE CONSIDERED EARNED AS CARGO BEING LOADED ON BOARD, WHETHER VESSEL AND/OR CARGO LOST OR NOT.
运费率:每公吨 美元, 船东不负责装货、卸货、理舱、平舱等费用,并以一个装港一个卸港为准。
8. 25% OF OCEAN FREIGHT SHOULD BE PAID VIA CHARTER’S AGECY ACCOUNT FREE OF ANY RISK TO OWNER INTO OWNRES ACCOUNT W/I 3 BANKING DAYS AFTER CHARTER PARTY SIGNED,IF DEPOSIT IS NOT PAID, OR OWNER HAS RIGHT TO WITHDRAW THIS F/N, BUT CHRTS SHOULD STILL BE RESPONSIBLE FOR ALL LOSSES AND CONSEQUENCES. BALANCE 75% FREIGHT TO BE PAID WITHIN 3 BANKING DAYS AFTER COMPLETION OF LOADING/RELEASING BS/L BUT ALWAYS BBB. AND IF VESSEL CAN NOT LOAD CARGO W/I 3 DAYS AFTER ARRIVAL AT LOADING PORT DUE TO CGO/DOC NOT READY, OWNERS HAVE RIGHT TO WITHDRAW THIS F/N AND DEPOSIT SHOULD BE NON-RETURNABLE.
在签完合同后三个银行工作日内,支付25%的运费作为保证金到船东指定账上.如果没有支付此保证金,船东有权取消此合同,并保留追溯租家的权力.余下的75%运费,将在装完货后支付,但通常在船舶到达卸港前支付.如果船舶不能在到达装港后,由于货物或者单证不能备妥,未能在三天内开始装货,船东有权力取消此合同,保证金不能返还.
9. VESSEL FREE ANY OF OAP & EXTRA INSURANCE AGAINST VSL’S AGE.
船舶不负责由于船舶年龄所产生的船舶超龄保险及其他额外的保险.
10. THE OWNER SHALL GIVE BY FAX VESSEL’S 3/2 DAYS ETA NOTICE AND 24HOURS DEFINITE NOTICE FOR THE VESSSEL ARRIVING/APPROXIMATE QUANTITY/DRAFT BEFORE ARRIVING LOADING PORT TO CHARTERERS.
THE OWNER SHALL GIVE BY FAX VESSEL’S SAILING ADVICE WITHIN 1 DAY AFTER SAILING AND 24HOURS DEFINITE NOTICE BEFORE ARRIVING DISCHARGING PORT TO CHARTERERS.
船东或船舶在抵港前3/2天给租家发预抵报, 在抵装港前24小时发确报及宣载量.
船东或船舶在离装港后一天内给租家发开航报,在抵卸港前24小时发确报.
11. OWRS AGTS BENDS BUT OWRS TO NOMINATE VICOSA AS LDPT AGT AND TO NOMINATE CHTRS RECOMMAND AGT AT DISPT SUBJ REASONBL P/DISB TB APRVD BY OWRS.
装卸港代理由船东指定,但船东指定VICOSA作为装港代理,卸港代理由租船人提命,但代理费需经船东同意。
12. LIGHTERAGE, LIGHTENING AT BOTH ENDS IF ANY TO BE FOR CHARTERER’S ACCOUNT. 过驳费, 减载费,由租船人负责
13. ANY TAXES/DUES/ WHARFAGES ON CARGO TO BE FOR CHARTERERS’ ACCOUNT, SAME ON VESSEL AND/ OR FREIGHT TO BE FOR SHIPOWNERS’ ACCOUNT.
任何有关货物的费和税,码头费用由租船人负责,同样地,有关船舶的和运费的,由船东负责.
14. NOTICE OF READINESS INOR IS TENDERABLE AT WORKING TIME LOCAL OFFICE HOURS AT LOADING PORT AND DISCHARGING PORT UPON VSL’S ARRIVAL BY FAX/TLX/CABLE IN WRITING, WHETHER IN BERTH OR NOT, WHETHER IN PORT OR NOT, IN ALL RESPECTS READY TO LOAD OR DISCHARGE. PILOTING VSL TO THE L/D BERTH OR ANCHORAGE, CHECKING DRAFT, JOINT INSPECTION SHALL NOT COUNT AS LAYTIME.
船舶备妥通知书, 在装卸港在船舶到达时, 在当地办公的时间内, 以传真/电传/电报的书面形式,不论船舶是否靠泊与否,不论船舶是否在港内. 在装卸港,船舶引水到泊位或者锚地的时间,检查吃水,联检不算作装卸货时间.
15. LAYTIME SHALL COMMENCE TO COUNT AT 1300PM, IF NOR TENDERED BEFORE 1200AM DURING OFFICE HRS AND AT 0800AM ON NEXT WORKING DAY IF NOR TENDERED IN AFTERNOON FROM MONDAY TO SATURDAY, UNLESS LOADING/DISCHARGING SOONER COMMENCE. TIME FOR LOADING/DISCHARGING NOT TO COUNT FROM 0430PM ON SATURDAY UNTIL 0800 AM ON MONDAY .IN WHICH CASE THE ACTUAL TIME USED TO COUNT. LAYTIME NON-REVERSIBLE BETWEEN LOADING AND DISCHARGING PORT.
如果船舶在12点前递交NOR, 则装卸货时间在1300点开始计算,如果船舶在周一到周六12点后递交NOR, 则装卸货时间在下一个工作日的早上8点开始计算.如果在马上开装/卸,则按实际使用的时间计算.装卸货时间是不可逆的.
16. ENTIRE CARGO TO BE DELIVERED AGAINST ORIGINAL BILLS OF LADING OR CHTRS AND RECEIVER’S L.O.I IN SHIPOWNERS P&I FORMAT.
全部的货物依据正本的提单或者以船东的船东互保协会的格式出具的租家和收货人保函放货.
17. CARGO QUANTITY TO BE ASCERTAINED ACCORDING TO VSL’S ACTUALLY DRAFT BY JOINT DRAFT SURVEY AT BOTH ENDS. OF WHICH DRAFT SURVEY TO BE ARRANGED BY
CHRTRS AND AT THEIR ACCOUNT AT BOTH ENDS
在装卸港,货物的数量依据船舶的实际吃水,由测量水尺, 联合公估确定.此由租方安排并由租方支付其费用.
18. SHIPOWNERS GUARANTEE THAT VESSEL'S GEARS SHOULD BE IN GOOD CONDITIONS. IN CASE VESSEL' S GEARS BREAKDOWN, DURING TOPPING OFF OPERATIONS AT THE ANCHORAGE AT PORT, TIME LOST DUE TO VESSEL' GEAR BREAKDOWN SHALL NOT COUNT AS LAYTIME, LOADING RATE WILL BE DEDUCTED PRO RATE.
船东保证船舶的吊机是在完好状态下的,如果船舶在锚地装货时,由于船舶吊机损坏而造成的时间损失不算入装卸货时间,装率按比例扣减
19. OTHER TERMS AND CONDITIONS AS GENCON C/P 1994
其他条款和条件以经1994年修订的"金康合同"条款为准。
20.ARBITRATION: IN HONGKONG AND ENGLISH LAW TO BE APPLIED.
仲裁: 以英国的法律,在香港仲裁.
