建筑工程劳务承包合同

根据平等、自愿、诚实信用的原则，经双方洽商，甲方将工程中相关分项工程发包给乙方实施完成。为明确双方责、权、利的关系，双方协商一致，订立本合同。

二、乙方承包工程范围：
1.甲方向乙方提供经审查的设计施工图纸，除土石方工程、给、排水工程、电、气、暖工程、外墙保温、隔热工程、门窗工程、外墙漆、涂饰工程、阳台栏杆、楼梯栏杆、防水工程外，均由乙方组织人员完成。
2.本工程所需用的机械设备，除塔吊、龙门吊、搅拌机由甲方提供外，其余机械均由乙方自备。
3.所有建筑材料（如：钢材、水泥、砼、砖、砂子、石子等材料）均由甲方提供。
4.除乙方钢筋工需用的绑扎丝、切割片、焊条、焊剂和架模工所需的铁丝、钉子外，本工程所使用的周、辅助材料其余均由甲方提供。
三、工程工期要求：
工期从2014年月日至201年月日完工，总工期日历天。乙方开工前十日内，向甲方提供总进度计划，每月提供月进度计划和每月完成情况报表。乙方按进度计划组织施工，满足甲方的总工期要求。当甲方原因（除人力不可抗力的自然灾害）影响工期或停工待料时，工期相应顺延。超过7天时，按现场实有人数每人每天元补偿给乙方工人生活费。
四、质量要求：
1.质量要求：合格。质量标准：按工程所在地现行施工规范和验收标准。
2.若乙方出现不合格产品时，应返工重做。造成甲方材料损失费用按成本价2倍计算赔付。此赔付由甲方直接在本月的劳务工资中扣除。
3.乙方在施工过程中若出现材料浪费，按成本价3倍计算赔付。若出现工地材料偷盗变卖等情况，经发现后按原价10倍处罚。情节严重时移交公安机关处理。
五、安全责任：
1.乙方在施工过程中严格按照本工种的安全操作规程和安全技术交底进行施工作业，做到不蛮干、不冒险、不违章。
2.乙方根据现场情况，按照59-2011的检查标准，准时、有效、搭设可靠的安全防护设施。
3.乙方不得聘用不宜从事建筑行业或患有病的人员以及国家规定的人员进场施工作业。
4.乙方在施工过程中若出现伤、残、亡等事故，除由保险公司赔偿金额外，其差额由甲、乙双方均等承担。
不得超过15天，否则甲方有权解除合同，并要求乙方承担违约责任。
5、劳务工资支付方式：甲方向乙方支付劳务工资时，应当开具正规，并在上注明工程名称、工程量、劳务单价、劳务工资总额等信息。同时，甲方应当及时将劳务工资支付情况告知乙方，并提供相应的支付凭证。乙方应当在收到劳务工资后及时核对并签字确认。
6、劳务工资的税费由乙方承担，甲方不负责任。乙方应当按照国家税收法规的要求缴纳税款，并及时向甲方提供相关的税务证明文件。
7、若乙方未按时完成工程量，甲方有权扣除相应的劳务工资。同时，乙方应当积极采取措施加快工程进度，确保按时完成工程量。若因乙方原因导致工程延误，乙方应当承担相应的违约责任。
